Khung pháp lý châu Âu không thiếu các quy định có thể áp dụng trực tiếp hoặc gián tiếp cho công nghệ nhận diện khuôn mặt nhằm mục đích nhận dạng trong các cơ quan thi hành pháp luật. Tuy nhiên, các quy định đa dạng này, với mục tiêu khác nhau và đến từ nhiều nguồn khác nhau, đã tạo nên một kiểu cấu trúc pháp lý không đồng nhất, có thể làm suy yếu việc sử dụng hợp pháp công nghệ này trong các cuộc điều tra hình sự. Bài báo này đề xuất việc xây dựng một đạo luật cụ thể về việc sử dụng công nghệ nhận diện khuôn mặt cho mục đích nhận dạng trong các cơ quan thi hành pháp luật, dựa trên các quy định hiện có, để giải quyết cụ thể những vấn đề cấp bách phát sinh trong lĩnh vực này. Mục tiêu cuối cùng là cho phép sử dụng công nghệ này dưới những điều kiện nhất định và bảo vệ quyền lợi của các cá nhân liên quan, đồng thời cũng cung cấp cho các cơ quan thi hành pháp luật những công cụ cần thiết để chống lại tội phạm nghiêm trọng.
