In the context of the excellent seminar organised by ERA on 14 and 15 May 2009 co-funded by the European Commission and attended by over 100 participants from 25 member states, the Article considers fundamental defects in the Civil and Commercial Courts; the need to integrate mediation into Court procedure and for judges to be trained in mediation. The Article considers international and EU wide mediation initiatives in Family, Consumer and Commercial disputes in an historical context. It analyses in detail the 2008 Cross Border Mediation Directive and calls for international as well as EU standards of conduct for Mediation and Mediators.
