Chúng tôi cung cấp các dữ liệu cho thấy rằng trong các thị trường dịch vụ: (i) các hạn chế đối với đầu tư trực tiếp nước ngoài (FDI) đang trong quá trình cải cách, (ii) các Mua lại & Sáp nhập xuyên biên giới chiếm ưu thế như là phương thức gia nhập FDI, và (iii) thường có sự tập trung thị trường cao. Dựa trên những dữ liệu này, chúng tôi trình bày một mô hình để phân tích chính sách mua lại và sáp nhập xuyên biên giới trong các thị trường dịch vụ tự do với việc xem xét tới hiệu quả và các tác động của quyền lực thị trường. Các phát hiện của chúng tôi cho thấy một chính sách sáp nhập, nhưng không phải là một chính sách phân biệt đối xử với người nước ngoài, dường như là hợp lý. Hơn nữa, các chính sách đảm bảo cạnh tranh cho các công ty mục tiêu trong nước cũng dường như là cần thiết. Trong bối cảnh này, việc hài hòa quy định về tiếp quản trong EU có thể đặc biệt mang lại lợi ích cho các chủ sở hữu tài sản ở các quốc gia có nhiều công ty mục tiêu.
